Thank you for taking the time to respond. I can tell you that once a homeowner is educated as to what the lenders did to the market and to them in their misrepresentation of values of properties it does not take long for them to realize that they are a victim of the fraud that was exacted upon many homeowners. To stay in a home and continue to pay on a mortgage that is derived from this misrepresentation is just financial imprisonment. Now, if a homeowner that has all of the facts decides to remain in their home, then at least it is an informed decision.

They also realize that if they have a fixed mortgage, and can lower their payments more, they will win out in the next few years as rental rates in good neighborhoods are exorbitant compared to buying right now, and as demand continues to increase it will NOT be fun to be a renter.  Fixed mortgages over the next 30 years, at these record low rates will win out.

Yes, it is a requirement that the home be your primary in order to qualify for HAFA. Were you informed to seek legal counsel at any point in the short sale? I don&#039;t recommend anyone attempt a short sale without it. These issues are better addressed prior to listing the home. That said, it is water under the bridge. Until you agree to the terms from the servicer, you don&#039;t have to close the transaction. So, have you communicated your approval with those terms? If not, don&#039;t close till the terms are acceptable to you. The proposed closing date is just that, proposed. Chase denied our HAFA application stating, &quot;We are unable to verify that you live in the Property as your primary residence.&quot;  This was alleged sent to us in September 2011.  Our application was supposedly sent via our short sale specialist/agent/broker in June 2011.  We have buyers in a pending short sale transaction set to be completed by 1/20/12.  The HAFA was not part of the short sale approval.  Our short sale agents/brokers never explain the HAFA denial to us when they found out about the denial. We never received the September HAFA denial letter.  Therefore, we never had any chance of appealing the HAFA denial or providing verifying information that we live the Property as our primary residence.  Of course, we had provided our agents/brokers with our tax returns and pay stubs showing the Property as our primary tax filing or primary residence.  We are currently renting a house.  Question:  What are our legal rights with respect to agents/brokers AND Chase?  Your prompt respond is requested.</description>
